The following Terms of Use outline your obligations when using the Agile Development website. You can also review our Privacy Policy, which outlines our obligations and practices towards handling any personal information that you may provide to us.

1. Agreement

By using the Site, you agree to be bound by our Terms of Use (the "TOU"). If you do not agree to the terms and conditions contained in the TOU and Agile Development privacy policy, please do not access or otherwise use the Site or any information contained herein.

2. Modifications of the Terms of Use

We may modify the Site at any time without prior notice, and you accept those modifications if you continue to use the Site. You should check the Site frequently to see recent changes.

In addition, we reserve the right at any time to:

Change the terms and conditions of the TOU;

Change the Site, including eliminating or discontinuing any content or feature of the Site.

3. Your Registration Obligations

You may not (i) select or use as a Agile Development User ID a name of another person with the intent to impersonate that person; (ii) use as a Agile Development User ID a name subject to any rights of a person other than you without appropriate authorization; or (iii) use as a Agile Development User ID a name that is otherwise offensive, vulgar or obscene. We reserve the right to refuse registration of, or cancel a Agile Development User ID at our discretion; if you select a User ID for your account we reserve the right to remove or reclaim it if we believe it infringes upon another’s rights or marks. You are responsible for maintaining the confidentiality of your Agile Development password.

Services are available only to individuals who are at least 18 years old, whether acting on their own behalf or as an authorized employee or representative of a corporation or other business entity. If you are under 18 years old, do not attempt to register or use the Services.

Mass or serial account creation may result in account termination. Please contact us if you planning to create multiple accounts.

4. User Conduct

As a condition of use, you promise not to use the Services for any purpose that is unlawful or prohibited by these Terms of Use, or any other purpose not reasonably intended by Agile Development. We respect other people’s rights and we expect you to do the same.

By way of example, and not as a limitation, you agree not to use the Services:

1.to abuse, harass, threaten, impersonate or intimidate other Agile Development users;

2.to post or transmit any content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, profane, or otherwise violates any law or right of any third party, or content that contains homophobia, ethnic slurs or religious intolerance;

3.for any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;

4.to post or transmit any communication or solicitation designed or intended to obtain password, account, or private information from any Agile Development user;

5.to create or submit unwanted email (“Spam”) to any other Agile Development users or any URL;

6.to violate any laws in your jurisdiction (including but not limited to copyright laws);

7.to submit stories or comments linking to multi-level marketing schemes

8.with the exception of accessing RSS feeds, you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (iii) bypass any measures we may use to prevent or restrict access to the Site;

9.with the intention of artificially inflating or altering Agile Development followers, comments, or any other Agile Development service, including by way of creating separate user accounts for the purpose of artificially altering Agile Development services; giving or receiving money or other remuneration in exchange for followers; or participating in any other organized effort that in any way artificially alters the results of Agile Development services;

10.attempt to impersonate another user or person;

11.sell or otherwise transfer your profile. 

In addition, you agree that you will not use any third party, or pay or otherwise attempt to influence any third to manipulate or otherwise affect the site in any manner (including, without limitation, by paying any other user to “follow” any content).

Agile Development may remove any content and Agile Development accounts at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such content), or for no reason at all. You are solely responsible for your interactions with other users of the Site. Agile Development reserves the right, but has no obligation, to monitor disputes between you and other users.  

6. Content submitted or made available for inclusion on the service

By creating and posting content to Agile Development, you warrant that you own all rights to the content, agree that the content will be dedicated to the public domain under the Creative Commons Public Domain Dedication, available at http://creativecommons.org/publicdomain/zero/1.0/ and that you will not object to the use of the content by Agile Development in any context. To clarify, the above does not apply to the content on external sites linked to by the original submission.

7. Copyright Policy

Articles and letters appearing in Agile Development are copyrighted and belong to their respective contributors.  All articles may be freely distributed electronically provided that they are distributed in their entirety and include the following notice:

8. Responsibility for User Submission

Each individual who submits an article, whether published on the Site or not, is solely responsible for her or his own acts, including the content, context or information. This means that each individual, and not Agile Development, is entirely responsible for anything and everything she or he posts on the Site including. Agile Development  does not, and does not intend to, pre-screen any comments posted on its Site, and Agile Development cannot and does not guarantee the accuracy, integrity or quality of anything that may appear on its Site.

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent the following information:

•16.1: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

•16.2: a description of the copyrighted work that you claim has been infringed, including the URL (web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;

•16.3: a description of where the material that you claim is infringing is located on the site, including the URL;

•16.4: your address, telephone number, and email address;

•16.5: a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

•16.6: a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

You acknowledge that Agile Development has no control over, and no duty to take any action regarding: which users gain access to the Site or use the Services; what effects the content may have on you; how you may interpret or use the content; or what actions you may take as a result of having been exposed to the content. You release Agile Development from all liability for you having acquired or not acquired content through the Site or the Services. You understand and agree that Agile Development may, under certain circumstances and without prior notice to you, terminate your access to and use of the Site. Cause for such termination shall include, but not be limited to, (i) breaches or violations of the TOU or other agreements or guidelines, (ii) requests by law enforcement or other government or regulatory authorities or (iii) repeat violators of third party copyrights or other intellectual property.
